4. No Staff Placement is Guaranteed
The submission of a staffing enquiry does not create a binding contract or guarantee placement of workers. All workforce arrangements are subject to:
- Review and confirmation of project requirements
- Availability of suitable workers at the time of enquiry
- Agreement of scope, rates, shift patterns, and responsibilities in writing
- Confirmation of site access, documentation, and induction requirements
- Any other conditions agreed in writing prior to deployment
5. Availability Confirmed Individually
Staffing availability, workforce capacity, and driver supply are subject to availability at the time of enquiry. No standing workforce numbers, guaranteed headcount, or guaranteed response times are implied by this website or its content.
6. Role Suitability Assessed per Enquiry
The suitability of any worker for a specific role is assessed individually per enquiry. Role requirements, task scope, environment, supervision arrangements, and relevant documentation are reviewed before any placement is confirmed.
7. Site Access and Induction Requirements
Site access requirements, induction processes, PPE requirements, data centre access conditions, and any site-specific rules are the responsibility of the client and vary per project and site. These are reviewed and confirmed per enquiry before any deployment commences.
8. Specialist and Technical Works
Specialist, regulated, electrical, high-risk, or otherwise technically qualified works should be supervised by or carried out by appropriately qualified professionals where required. Workers supplied by Surge Data Centre Services Limited are project-based support operatives. No engineering qualifications, electrical qualifications, data centre engineering credentials, or specialist technical certifications are implied unless explicitly confirmed in writing per placement.
9. HGV Driver Enquiries
HGV driver supply enquiries are reviewed individually around licence class, location, shift pattern, vehicle type, client requirements, site access, and documentation checks. The following apply to all driver supply:
- No same-day driver cover is guaranteed
- No nationwide driver pool or guaranteed national coverage is implied
- No owned fleet is implied
- Licence class, CPC qualification card, and documentation requirements are reviewed per placement
- Driver compliance with current transport legislation is the driver's responsibility; applicable obligations of the transport operator remain with the operator
- All driver supply arrangements are confirmed per individual enquiry
10. Shift Patterns, Rates, Duration, and Scope
Shift patterns, hourly or daily rates, project duration, responsibilities, staffing numbers, and scope of work are agreed per project on a case-by-case basis. Nothing on this website implies a fixed rate, standard rate, or pre-agreed terms.
11. Client Responsibilities
By submitting a staffing enquiry, the client accepts responsibility for:
- Providing accurate and complete information about the project, role requirements, site conditions, and access arrangements
- Ensuring appropriate supervision of workers on site
- Ensuring site safety, safe systems of work, and compliance with applicable health and safety legislation
- Providing accurate role descriptions and any specific requirements before placement is confirmed
- Engaging appropriately qualified professionals for specialist, regulated, or high-risk technical works
- Managing site induction, PPE provision, and site access as required by the client's own policies and applicable law
12. Limitation of Liability
To the maximum extent permitted by applicable law, Surge Data Centre Services Limited shall not be liable for any indirect, consequential, or incidental losses arising from the use of this website or reliance on its content.
